Virtual Office Website (VOW) terms governing the use of MLS data and property search.
These Terms of Use establish a lawful broker-consumer relationship between You and Iron Mountain Realty LLC, through Associate Broker Judy Beltran acting under the supervision of Principal Broker Matthew Leeper, solely for the purpose of providing You with access to real estate listing data available through the Platform’s Virtual Office Website (“VOW”) and voice agent services.
In accordance with Utah Administrative Code R162-2f-401a and the requirements of the NAR Virtual Office Website Policy, the following disclosures are made:
The Platform is operated by Judy Beltran, an associate broker holding an active license issued by the Utah Division of Real Estate, affiliated with Iron Mountain Realty LLC. Pursuant to the NAR Virtual Office Website Policy, Section I.1(b), this VOW is operated by a non-principal broker with the consent of the MLS Participant (Iron Mountain Realty LLC, through its Principal Broker) and is subject to Matthew Leeper’s oversight, supervision, and accountability. The Platform operates under the supervision of Principal Broker Matthew Leeper, as required by Utah Code § 61-2f-206(5) and § 61-2f-302. Judy Beltran and all licensees affiliated with Iron Mountain Realty LLC are subject to the regulatory authority of the Utah Real Estate Commission and the Utah Division of Real Estate under Utah Code Title 61, Chapter 2f.
Your registration and use of this Platform does not establish any agency relationship between You and Judy Beltran, Iron Mountain Realty LLC, Principal Broker Matthew Leeper, or any affiliated licensee. No fiduciary duties — including but not limited to loyalty, obedience, full disclosure, confidentiality, reasonable care and diligence, safekeeping of funds, or any additional contractual duties as described in Utah Administrative Code R162-2f-401a(1) — are owed to You as a result of this registration.
As a Registrant under these Terms of Use, You are an unrepresented consumer. You are not receiving brokerage representation services. The data and information made available to You through the Platform is provided for Your informational purposes only and does not constitute real estate advice, a recommendation, or a professional opinion regarding any specific property or transaction. You are encouraged to seek the advice of qualified professionals — including licensed real estate agents, inspectors, lenders, attorneys, tax advisors, and title agents — before making any real estate decisions.
Should You wish to engage Judy Beltran or any licensee affiliated with Iron Mountain Realty LLC for brokerage representation services, including but not limited to property tours (in person or live virtual), offer preparation, negotiation, or transaction management, a separate written Buyer-Broker Agreement must be executed prior to the commencement of such services. Any such agreement will be between You and Iron Mountain Realty LLC, acting through its Principal Broker or a designated licensee. Pursuant to the practice changes required by the National Association of REALTORS® settlement effective August 17, 2024, a written buyer agreement is required before touring a home. That agreement will be presented to You separately and will contain, at minimum: a specific disclosure of the amount or rate of compensation; a term prohibiting the agent from receiving compensation exceeding the agreed amount; and a conspicuous statement that broker fees and commissions are not set by law and are fully negotiable.
Before accessing MLS listing data through the Platform, You must complete the following registration process:
Iron Mountain Realty LLC will maintain a record of Your name, email address, username, and current password for not less than one hundred eighty (180) days following the expiration of Your password. These records may be disclosed to the MLS upon request if the MLS has reason to believe that a breach in data security or a violation of MLS rules has occurred.
By accepting these Terms of Use, You affirmatively acknowledge and agree to the following:
The listing data displayed on this Platform is supplied by the MLS and is deemed reliable but is not guaranteed accurate by the MLS, by Iron Mountain Realty LLC, by Principal Broker Matthew Leeper, by Judy Beltran, or by Security Lion. All data is subject to errors, omissions, changes in price, prior sale, or withdrawal without notice. You should independently verify any information before relying on it for any purpose.
Each listing displayed on this Platform will identify the name of the listing firm and the name of the listing agent in a readily visible, reasonably prominent location and typeface.
MLS listing data displayed on this Platform is refreshed not less frequently than every three (3) days.
The Platform provides data and information for Your review. Nothing on this Platform — including but not limited to listing information, market data, estimated values, maps, neighborhood information, or any output generated by the voice agent — constitutes brokerage advice, a professional opinion, a recommendation to purchase or sell any specific property, or a substitute for the professional judgment of a licensed real estate agent, attorney, inspector, appraiser, lender, or other qualified professional.
To the maximum extent permitted by applicable law, Iron Mountain Realty LLC, Principal Broker Matthew Leeper, Judy Beltran, Security Lion, and their respective officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to Your use of this Platform, the data or information provided herein, any errors or omissions in such data, or any action taken or not taken in reliance on such data.
The voice agent and web-based search features of this Platform are powered by artificial intelligence and automated systems provided by Security Lion. Automated outputs may contain inaccuracies. You acknowledge that interactions with the voice agent do not constitute a conversation with a licensed real estate professional unless Judy Beltran or a licensee affiliated with Iron Mountain Realty LLC expressly identifies themselves as such during the interaction.
You agree that You will not use the Platform or any data or information obtained from the Platform for any of the following purposes:
Iron Mountain Realty LLC and Security Lion are committed to protecting Your privacy. The following describes how information obtained from You through this Platform will be collected, used, and safeguarded:
We collect: Your name, email address, username, and password as provided during registration; records of Your search activity on the Platform (including search criteria, properties viewed, and saved searches); and, if You interact with the voice agent, transcripts or recordings of such interactions. If You voluntarily provide additional information (such as property preferences, location, budget, or contact details), that information will also be collected.
Your information will be used to: provide You with access to MLS listing data and Platform features; communicate with You regarding Your account, including password expiration and Terms of Use updates; respond to Your inquiries about properties displayed on the Platform; comply with MLS rules and applicable law, including furnishing registration records to the MLS upon lawful request; and improve the functionality and performance of the Platform.
Your information may be disclosed to: the MLS, as required by MLS rules (including Your name, email address, username, password, and activity audit trail if the MLS has reason to believe a security breach or rule violation has occurred); Judy Beltran and licensees affiliated with Iron Mountain Realty LLC, for the purpose of responding to Your property inquiries; Security Lion, solely in its capacity as the technology provider operating the Platform; and as required by law, regulation, or legal process.
We employ reasonable security measures to protect Your information from unauthorized access, use, or disclosure. No system can guarantee absolute security, and You acknowledge that You provide information at Your own risk.
Iron Mountain Realty LLC and Security Lion will not sell, rent, or lease Your personal information to third parties for marketing or commercial purposes unrelated to the services described in these Terms of Use.
This agreement is entered into electronically in accordance with the Utah Uniform Electronic Transactions Act, Utah Code Title 46, Chapter 4.
The MLS database and all listing data provided through this Platform are the copyrighted property of the applicable MLS. “Precision Quotes Real Estate Tech” is a branded product of Iron Mountain Realty LLC. The Platform’s design, software, voice agent technology, and non-MLS content are the property of Security Lion and/or Iron Mountain Realty LLC, as applicable. All rights not expressly granted to You under these Terms of Use are reserved.
You may contact the brokerage at any time through the following channels to ask questions, request information about properties displayed on the Platform, or inquire about brokerage representation services:
Judy Beltran, or another licensee affiliated with Iron Mountain Realty LLC under the supervision of Principal Broker Matthew Leeper, will be willing and able to respond knowledgeably to inquiries from Registrants about properties within the market area served by Iron Mountain Realty LLC and displayed on this Platform.
You may terminate this agreement at any time by discontinuing Your use of the Platform. You may request deletion of Your registration by contacting Iron Mountain Realty LLC using the contact information provided in Section 11. Termination does not affect the record retention obligations described in Section 4.1.
Iron Mountain Realty LLC may suspend or terminate Your access to the Platform at any time, with or without cause, including but not limited to violation of these Terms of Use, suspected misuse of MLS data, or direction from the MLS.
Iron Mountain Realty LLC reserves the right to modify these Terms of Use at any time. Material changes will be communicated to You via the email address on file. Your continued use of the Platform after notification of changes constitutes acceptance of the modified Terms. If You do not agree to the modified Terms, You must discontinue use of the Platform.
These Terms of Use shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms of Use shall be resolved in the state or federal courts located in the State of Utah, and You consent to the personal jurisdiction of such courts.
If any provision of these Terms of Use is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect the validity or enforceability of the remaining provisions.
These Terms of Use constitute the entire agreement between You and Iron Mountain Realty LLC with respect to the subject matter hereof — namely, Your registration for and use of the Platform for the purpose of accessing MLS listing data. This agreement supersedes all prior or contemporaneous communications, whether electronic, oral, or written, with respect to such subject matter. For the avoidance of doubt, this agreement does not supersede, replace, or modify any separate Buyer-Broker Agreement, listing agreement, purchase agreement, or other written agreement that may be entered into between You and Iron Mountain Realty LLC or any affiliated licensee.
